"We/us" means Keen Travellers
"The Event" means any holiday, accommodation, activity, or function organised or advertised by us
"You" means the person who has signed the booking form and includes all those on whose behalf you have signed
"Supplier" means the company or person that is holding or providing the event or any part of it
"Price" means the total cost of the event
"FCC" means Future Cruise Deposits
1. Terms and Conditions
This contract is governed by these terms and conditions, which exclude all other terms and conditions except those implied by law. No variation to these terms shall be valid unless it is in writing and signed by both you and the company director.
2. Formation of Contract
A contract is not formed between you and us until we have received the deposit payable and we have sent written confirmation of our acceptance of your booking. This confirmation may be in the form of an email.
3. Lead Name
The person whose name appears first on the booking is responsible for collecting the full balance payable and ensuring that all group members are aware of our terms and conditions. This person is also responsible for completing the online guest list for all persons on the booking. By booking via email or telephone, you agree to and accept our terms and conditions. If any individual in your group fails to pay, you will indemnify Keen Travellers against any loss.
4. Payment & Deposits
At the time of booking, you must pay a non-refundable, non-transferable deposit. The balance is due by the agreed date on your confirmation contract, no less than 56 days (8 weeks) before the event. Failure to pay by the due date may result in cancellation and a late fee of £10 per person. Deposits are used by us to enter into contractual arrangements on your behalf and are non-refundable.
5. Financial Protection
Keen Travellers offers full financial protection for your booking in accordance with "The Package Travel, Package Tours Regulations." All payments are held in an independent Trust Account managed by Protected Trust Services Ltd and Elman Wall Ltd, Chartered Accountants.
6. Cancellation by Us
We may cancel the event or any part of it due to safety concerns, adverse weather, or other factors beyond our control. If we cancel the entire event, we will either reschedule it or provide a refund of the cost to us of the event.
7. Cancellation by You
You may cancel your booking within 14 days of making the initial deposit, but the deposit is non-refundable. After 14 days, cancellation is still possible, but all deposits and payments made are non-refundable. Cancellation fees vary depending on the timing and can range from 25% to 100% of the total cost.
8. Failure to Provide an Event
If the event cannot take place due to circumstances beyond our control, we will provide an alternative event or a refund of the cost to us of the event.
9. Accommodation
Accommodation details may not be disclosed until you receive confirmation from the supplier. If you book a "guarantee stateroom," it will be assigned when you board or earlier.
10. Future Cruise Deposits
Future Cruise Credits (FCCs) are vouchers issued for future travel. The terms and conditions for using FCCs vary by cruise line, and some may restrict their use for initial deposits or extras.
11. Meals and Seats
Meals are not included unless specified. For restaurant bookings, pre-orders may be required. We are not responsible for meal delays or unavailability. Seat assignments on flights are managed by the airline and are subject to change.
12. Unaccompanied Minors and Children
Parents/guardians are responsible for providing all necessary information and documentation for unaccompanied minors or children traveling without a parent. We are not liable for issues arising from incorrect information.
13. Alterations + Surcharges Applied By Us
We may need to substitute a supplier or make other changes to the event. Additional costs may apply, and surcharges may be levied if the number of participants is not met.
14. Alterations Made by You
Requests for changes must be made in writing. You may increase the number of travelers if space is available. Reductions in the number of travelers may incur cancellation fees.
15. Your Obligations
You must behave responsibly and comply with instructions from us or suppliers. If you fail to do so, we may cancel or shorten the event without providing a refund.
16. Our Obligations
We will use reasonable care in organizing the event. If possible, we will reschedule the event instead of cancelling it or provide a refund. Photos on our website may not represent the actual products received.
17. Customer Feedback
If you encounter issues, report them to the relevant person immediately. If the issue is unresolved, contact us in writing within 7 days. Complaints after this period will not be accepted.
18. Contracts (Rights of Third Parties) Act 1999
No part of this agreement shall confer any rights on third parties to enforce any terms of this agreement.
19. Free Place or Discount
Any free place or discount offered by us is subject to specific terms and conditions and is only applicable as detailed in your booking confirmation. A free place or discount cannot be combined with other offers unless explicitly stated by us. If a free place or discount is offered and you cancel your booking, the full price of the event will be applicable, and any previous discounts will no longer apply.
20. Travel Insurance
We strongly recommend that you take out comprehensive travel insurance, including cancellation, medical cover, and personal liability insurance. This insurance should cover unforeseen circumstances such as illness, injury, or travel delays. You must ensure that your insurance covers all events and activities included in your booking, and provide us with proof of insurance if required.
21. Limitation of Liability
To the extent permitted by law, Keen Travellers’ liability for any loss, damage, or injury arising from the event is limited to the price paid for the event. We will not be liable for any indirect, special, or consequential loss, including but not limited to loss of earnings, inconvenience, or loss of enjoyment. Our liability is limited by the terms of this contract and any conditions imposed by our suppliers.
22. Force Majeure
Keen Travellers will not be held liable for failure to perform its obligations if such failure is due to a force majeure event. This includes, but is not limited to, acts of God, war, terrorism, government action, fire, flood, labor strikes, or other events beyond our reasonable control. In such cases, we will make reasonable efforts to provide an alternative or refund, as applicable.
23. Governing Law
These terms and conditions are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts in England and Wales.
24. Privacy Policy
Keen Travellers respects your privacy. Any personal data provided to us will be handled in accordance with our privacy policy. This may include the collection of personal information for the purpose of processing your booking, communicating with you, and complying with legal obligations.
25. Website Accuracy
We take all reasonable steps to ensure that the information presented on our website is accurate and up to date. However
, we cannot guarantee that all information, including prices and availability, is always correct. We reserve the right to make amendments to details, and we will notify you of any significant changes before confirming your booking.
26. Bookings via Third Parties
If you book an event through a third-party agent, these terms and conditions still apply. However, we are not responsible for any misrepresentation, failure to provide correct information, or issues caused by third-party booking systems.
27. Transfers
Where a transfer service is provided, you must ensure you are at the agreed location at the correct time for pickup. If there are any delays or missed transfers, we cannot be held responsible for additional costs or inconvenience.
28. Special Requests
Any special requests (e.g., dietary requirements, specific room preferences, etc.) must be notified at the time of booking. While we will make every effort to accommodate these requests, they are not guaranteed, and we cannot accept liability if they are not fulfilled.
29. Events Outside Our Control
Keen Travellers is not responsible for events or actions beyond our control, including delays, cancellations, or changes to the event, services, or facilities provided by our suppliers. This also includes situations involving civil unrest, flight delays, or natural disasters. In these cases, we will assist in rebooking or arranging alternatives where possible, but we are not liable for any additional costs incurred.
30. Important Notice Regarding Flights
Keen Travellers may book flights on your behalf through third-party suppliers. These flights are subject to the terms and conditions of the airline, which may change after booking. You are advised to check your flight details regularly for any amendments. We are not responsible for flight cancellations, delays, or any issues with flight bookings.
31. Testimonials
Any testimonials, reviews, or feedback from previous clients are their own personal opinions and experiences. We do not guarantee that all clients will have the same experience or outcomes. Your experience may vary.
32. Changes to Terms and Conditions
We may update or revise these terms and conditions from time to time. Any changes will be posted on our website, and the updated version will apply to all bookings made after the date of the change.
